Terms of Service

1. Acceptance of Terms

By accessing or using the BiscuitOps platform, website, or any associated services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and BiscuitOps. Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

2. Description of Service

BiscuitOps is a cloud-based animal management platform designed for breeders, kennels, catteries, and animal organizations. The Service provides tools for:

• Animal record management, including profiles, health records, and documentation.
• Breeding program management and litter tracking.
• Pedigree generation and lineage tracking.
• Contact and buyer/owner management.
• Multi-user access with role-based permissions for organizations.

Features may vary by subscription tier, and we reserve the right to modify, add, or remove features at any time with reasonable notice.

3. Account Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• Notifying us immediately of any unauthorized access or use of your account.
• Ensuring that all information associated with your account remains accurate and up to date.

You must be at least 16 years of age to create an account. By registering, you represent that you meet this age requirement. We reserve the right to suspend or terminate accounts that we reasonably believe have been created with inaccurate information or in violation of these Terms.

4. Subscription & Billing

BiscuitOps offers the following subscription tiers, each with different feature sets and usage limits:

• Basic: For individual hobbyist breeders with core management features.
• Professional: For active breeders who need advanced tools and higher usage limits.
• Business: For organizations and commercial operations requiring multi-user access and premium features.

Subscriptions are billed on a monthly or annual basis, as selected at the time of purchase. All fees are charged in advance and are non-refundable except as required by applicable law. If you cancel your subscription, you will retain access to paid features through the end of your current billing period.

We reserve the right to change subscription pricing with at least 30 days' notice. Price changes will take effect at the start of your next billing cycle following the notice period.

5. User Data & Content

You retain full ownership of all data, records, and content you create or upload to the Service, including animal profiles, health records, pedigree data, images, and documents ("User Content"). BiscuitOps does not claim ownership of your User Content.

By using the Service, you grant BiscuitOps a limited, non-exclusive, worldwide license to host, store, process, and display your User Content solely for the purpose of operating and providing the Service to you. This license terminates when you delete your User Content or close your account.

You are solely responsible for the accuracy and legality of the User Content you submit. We recommend regularly exporting backups of your data. While we maintain robust backup systems, BiscuitOps is not liable for any loss of User Content.

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable local, state, national, or international law or regulation.
• Upload or transmit any content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable.
• Attempt to gain unauthorized access to the Service, other user accounts, or any related systems or networks.
• Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure.
• Use automated scripts, bots, or scrapers to access the Service without our prior written consent.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Resell, sublicense, or redistribute access to the Service without authorization.
• Falsify animal records, pedigree information, or other data in a manner intended to defraud or mislead others.

We reserve the right to investigate and take appropriate action against any violations, including suspending or terminating accounts and reporting conduct to law enforcement authorities.

7. Intellectual Property

The Service, including its design, code, features, graphics, logos, and trademarks, is the intellectual property of BiscuitOps and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, reproduce, distribute, create derivative works from, or publicly display any part of the Service without our prior written consent.

Your use of the Service does not grant you any ownership interest in the Service or any of its components, other than the limited right to use the Service in accordance with these Terms.

8. Limitation of Liability

To the maximum extent permitted by applicable law, BiscuitOps and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the Service.

The Service is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the Service, including warranties of merchantability, fitness for a particular purpose, or non-infringement. Specifically:

• We do not guarantee that the Service will be uninterrupted, error-free, or completely secure.
• We do not warrant the accuracy or completeness of any information generated by the Service, including pedigree calculations or health record summaries.
• We are not responsible for decisions made based on data stored in or produced by the Service.

In no event shall our total aggregate liability exceed the amount you have paid to BiscuitOps in the twelve (12) months preceding the event giving rise to the claim.

9. Termination

You may close your account at any time through your account settings or by contacting our support team. Upon cancellation, your access to paid features will continue through the end of your current billing period.

We may suspend or terminate your account if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or if required to do so by law. We will make reasonable efforts to notify you before or promptly after any suspension or termination, except where doing so would compromise security or violate legal obligations.

Upon account termination, your right to access the Service ceases immediately. We will retain your data for up to 90 days to allow for account recovery or data export, after which it will be permanently deleted from our systems. We recommend exporting your data before closing your account.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware.

11. Changes to Terms

We may revise these Terms from time to time. When we make material changes, we will notify you by posting the updated Terms on our website with a revised "Last updated" date and, for significant changes, by sending a notification to the email address associated with your account at least 30 days before the changes take effect.

Your continued use of the Service after the effective date of any revised Terms constitutes your acceptance of those changes. If you do not agree with the updated Terms, you must discontinue use of the Service and close your account.
